The purchase prices stated below are non- refundable. All deposits are non-refundable (unavailability of sex, color, quality requested is the only exception). All dogs/puppies shall carry the prefix Excalibur. Full Registration Show potential/Breeder guarantee: $__________less deposit of $________ This dog is being sold with an AKC Full Registration and Breeder will guarantee as stated below. Limited Registration Companion Guarantee: $___________less deposit of $___________ This dog is being sold with an AKC Limited Registration. This means that the AKC can not register any progeny from this dog. This puppy/dog is for the sole purpose of being a family companion and not for breeding. This dog can be shown in AKC non-conformation events such as (i.e. obedience, agility, tracking, etc.). See below for companion quality guarantee. Warranty Applying to all dogs: The health of the above referenced dog is also warranted for 72 hours, (unless other arrangements have been made) in which purchaser is advised to have puppy examined by a veterinarian, against any immunized disease for which the breeder has obtained such immunization with the exception of parvo virus and heartworms. The health of the above referenced dog is warranted against genetic diseases which by determination of a competent veterinarian would lead to the euthanization of the said dog before 30 months of age. Warranty Applying to Show potential/Breeding dogs only: The above referenced dog is warranted to be free of any disqualifying faults as prescribed by the American Kennel Club (AKC) of America breed standard. It is also warranted to pass screenings required by OFA for a CHIC number (hips, thyroid panel, cardiac testing, CERF.),up to 30 months of age. This warranty in no way guarantees that this dog will finish an AKC Championship. It is recommended not to breed the dog / bitch before her second heat cycle . Exclusions From Warranty: This warranty will be null and void in the following instances: (1) for any nutrition related diseases (i.e. OCD, HOD, Panosteitis, etc... see care information attached hereto), (2) bloat (gastric torsion) (3) companion if you do not spay or neuter your dog by 8-10 months of age. Terms of Replacement: In the event that euthanization of the above referenced dog, before 30 months of age, is deemed to be in the best interest of the animal by a competent veterinarian because of the development of a genetic disease not to include demodectic mange or any nutrition related disease as specified above in the warranty. The said dog will be replaced, with one of same or similar quality from breeders next available litter. All veterinarian costs & shipping associated herein shall be the sole responsibility of the Purchaser. If the above dog is being sold under a show / breeding warranty, and said dog does not pass health screenings described under "Warranty applying to Show Potential/Breeding dogs", after furnishing proof of spay / neuter with said dogs microchip ID number and signature of veterinarian to Breeder, Breeder shall have the option to replace the dog with a dog of same or similar quality as available at no additional cost to Purchaser (excludes shipping). Purchaser (s) Responsibility: (All Puppies) Purchaser acknowledges herein responsibility for maintaining the said dog in a healthy, clean and safe environment for the dog’s lifetime. Purchaser further acknowledges responsibility for any and all appropriate medical care that is necessary for maintaining the health and welfare of the said dog (heart worm prevention, vaccinations, flea control, de-wormings, etc.). Purchaser further agrees to update Breeder on dogs progress at least every 3 to 6 months. (Companion): Optional but Preferred ; Purchaser agrees to have dog obedience trained by qualified trainer or new owner beginning no later than 8 months of age. PLACEMENT OF THE DOG WITH THIRD PARTIES: UNDER NO CIRCUMSTANCES IS THE SAID DOG TO BE SOLD, GIVEN, PLACED, OR OTHERWISE TRANSFERRED TO ANYONE NOT A PARTY TO THIS CONTRACT WITHOUT THE EXPRESS PERMISSION OF THE BREEDER. In the event such a transfer occurs without the said permission of the breeder, and the Breeder determines that the dog has been placed in an unfit environment, PURCHASER SHALL BE HELD RESPONSIBLE FOR ANY ATTORNEY FEES, COURT COSTS AND OTHER EXPENSES (NOT LIMITED TO RESCUE AND BOARDING FEES) INCURRED BY BREEDER IN THE RECOVERY OF THE SAID DOG. RETURN OF DOG TO BREEDER: If due to circumstances beyond the control of Purchaser the said dog must be given up by Purchaser, then the Purchaser shall IMMEDIATELY return the said dog to Breeder , THERE WILL BE NO CASH REFUNDS. In addition, the purchaser shall bring dogs current health record and return the dogs AKC registration papers signed over to Breeder. Any amendments to this contract must be in writing and signed by both parties. If this contract matter is taken to court for any reason purchaser is responsible for all court and attorney fees and further agrees that it would be taken to a Hardin County Kentucky court. By signature hereto, Purchaser acknowledges receipt of a copy of this Purchase Agreement/Contract, information package, including care schedule, vaccination record, and pedigree upon request. This contract must be signed and sent back to Excalibur Great Danes with-in 30 days of receiving puppy/dog or contract is null/void.
